First, there was NO final decision made on a pay-out formula or amounts. There was a consensus on how to move forward on a pay-out formula. At this time I will submit the proposed pay-out formulas that were discussed to the union attorney, National Business Agents Eric Wilson and Mike Gallagher and the Local’s accountant for review. It would be irresponsible of me, or any union official, to give out information on pay-out amounts or a specific date the pay-out will be paid until everything is finalized. We must be sure that whatever formula we use to distribute the settlement money will be defendable in the event of an Unfair Labor Practice or lawsuit being filed against the Local.
To clarify who is eligible to participate in the settlement – All currently working APWU represented craft employees, APWU represented craft employees who retired since September 1993, and the estates of APWU represented craft employees who became deceased.
To clarify whether or not the Local is entitled to any interest that accrues on the settlement money – No. There were no provisions in the settlement agreement to pay interest to the union on the settlement money. Furthermore, it was agreed in the settlement that the Local would determine who is to be paid and how much therefore it is through no fault of the Postal Service at this time that the settlement money has not been distributed.
When I have more information on the CILO settlement payment I will put that information out on Local letterhead. Again, if I didn’t tell you out of my own mouth or you didn’t read it posted on Local letterhead it is only rumor!
